Your Information, Respected

Privacy Policy

Beyond The Curve (“we”, “us”, “our”) is committed to protecting your privacy. We are an HR consultancy, and we understand that the information people share with us — as website visitors, clients, and candidates — is often personal and sometimes sensitive. This policy explains what personal information we collect, how we use it, and the choices you have.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

  1. What this policy covers

This policy applies to personal information we collect through our website, through direct contact with you (email, phone, or in person), and in the course of providing our HR consulting services.

  1. The personal information we collect

Depending on how you interact with us, we may collect:

  • Contact and enquiry information: your name, email address, phone number, business or organisation name, and the contents of any message you send us through our website enquiry form or by email.
  • Newsletter and marketing information: your name and email address, if you choose to subscribe to our updates.
  • Information you provide during our services: where you engage us for HR consulting, we may collect information about you, your employees, or candidates as needed to deliver the work.
  • Technical information (website analytics and cookies): When you visit our website, we may automatically collect limited technical information such as your IP address, browser type, device details, and pages visited. We use this information to understand how people use our site, improve functionality, and maintain security. Our website may also use cookies or similar technologies to enhance your browsing experience. You can adjust your browser settings to refuse cookies if you prefer, although some parts of the site may not function optimally without them. We do not use this information to identify you personally unless it is combined with other data you provide.

Sensitive information

Some of the information we handle as part of HR work is “sensitive information” under the Privacy Act: for example, details about health, workplace conduct, or employment history. We only collect sensitive information where it is reasonably necessary for our services and where you have consented, or where we are otherwise permitted or required by law. We take extra care to keep this information secure and to limit who can access it.

We do not collect sensitive information through our website’s contact form or newsletter signup, only your basic contact details.

  1. How we collect your information

We collect personal information directly from you when you:

  • complete an enquiry or contact form on our website;
  • subscribe to our newsletter;
  • email, call, or meet with us; or
  • engage us to provide HR consulting services.

Where it is reasonable and practical, we will collect your personal information directly from you. In the course of HR work, we may sometimes receive information about you from your employer or a third party: for example, when a business engages us to support a workplace matter.

  1. Why we collect and use your information

We use personal information to:

  • respond to your enquiries and provide the information or services you request;
  • deliver our HR consulting services and communicate with you about them;
  • send you newsletters and updates, where you have subscribed;
  • manage our relationship with you and keep our records accurate; and
  • meet our legal and regulatory obligations.

We will only use your information for the purpose we collected it for, a directly related purpose you would reasonably expect, or another purpose you have consented to.

  1. Marketing and how to opt out

If you subscribe to our newsletter, we will send you occasional updates and relevant HR content. You can unsubscribe at any time by clicking the “unsubscribe” link in any email we send, or by contacting us using the details below. We will action your request promptly.

  1. Who we share your information with

We do not sell your personal information, and we do not share it except as described here. We may disclose your information to:

  • Trusted service providers who help us operate, for example, our email/newsletter platform, IT and hosting providers, and administrative support. These providers are only permitted to use your information to perform services for us and must comply with privacy and data protection standards equivalent to those in Australia.
  • Others, with your consent, for example, where you have engaged us and asked us to liaise with a specific party.
  • Legal and regulatory bodies, where we are required or authorised by law to do so.

Some of our service providers may store data on servers located outside Australia. Where this happens, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.

  1. How we store and protect your information

We take reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification, and disclosure, including secure cloud-based storage, access controls, and confidentiality practices appropriate to the sensitivity of the information.

We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law, and then we take reasonable steps to destroy or de-identify it.

  1. Accessing and correcting your information

You have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, or incomplete. To make a request, contact us using the details below. We may need to verify your identity before providing access, and in limited cases the law allows us to decline a request, if so, we will explain why.

  1. Making a complaint

If you have a concern about how we have handled your personal information, please contact us first using the details below. We take privacy concerns seriously and will respond within a reasonable time.

If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

  1. Changes to this policy

We may update this policy from time to time. The current version will always be available on our website, and the “last updated” date at the top shows when it was last changed.
